Google Tightens Gambling Ad Compliance, Extends YouTube Reach to Certified Operators

Google has updated its gambling advertising restrictions, making it tougher for unlicensed gambling promoters. Going forward, brands without solid compliance documentation will find it difficult to reach players, while certified online gaming operators will gain access to premium YouTube inventory.

The most significant shift is Google’s stricter enforcement of certification requirements across gambling and game ads. Certification has always been a key step to running ads in this category, but Google is now making the process more rigorous for advertisers.

Certification Overhaul

Google first revamped the certification process on 26 August 2023, when it rolled out revised application forms and a new set of eligibility standards. All new applicants are now required to provide evidence of holding a valid local gambling license for every market they plan to target with their advertising.

This is a more stringent requirement than before. Previously, advertisers could submit a self-declaration of compliance, but the company has now demanded verifiable proof. "We expect that the requirement will be challenging for some existing platforms," said Joe Johnston, vice president of regulatory affairs at Harrah's.

Existing certified advertisers with changing licensing structures may also need to recertify. "If your certificate covers multiple jurisdictions, you may be required to certify again with a new form. That is something we are monitoring," Johnston noted.

Advertisers are also now mandated to maintain clear documentation of their compliance with local laws and age restrictions. Operator sites must prominently display information such as age warnings, links to responsible gambling resources, terms and conditions, and a footer with the licensor's name, license number, and a privacy policy.

Expanded Enforcement

Google didn't stop there. In a move designed to further enforce eligibility, the tech giant updated its gambling policy again several weeks later, on 14 September 2023. In a shift aimed at curbing rogue advertisers, Google announced that it would revoke certifications from accounts with repeated violations, and that advertisers subject to multiple improper gambling promotions could lose broader eligibility.

"What we have seen is that manager accounts are not always used to maintain fully compliant operations," said Johnston. However, the September policy did not specify at what point multiple violations constitute a pattern that could get advertisers banned.

Access to YouTube

Google's strategy is as much about restricting access as it is about extending premium ad space. Starting 21 October 2023, certified operators will gain access to YouTube's Masthead, a prime advertising slot at the top of the video site's homepage.

The Masthead is one of the most sought-after placements on the platform, typically used to promote major campaigns, like the launch of new products or premieres of TV shows. Gambling advertisements have not previously been permitted in this space.

However, after certification, online gaming operators can now advertise in this prominent position, with a concession that has simultaneously made the Masthead a valuable opportunity and created new requirements for marketers.

The Masthead is particularly effective, as per industry reports, "because YouTube audiences generate high on-site engagement, minimal negative feedback, and faster campaign budget utilization. Data shows Masthead campaigns combined with precise geo-targeting achieve significantly better viewer response rates."

Eligibility for YouTube Masthead advertising is also tied to Google's stricter certification. Operators must maintain certification, demonstrate compliance history, and follow local laws to qualify for the Masthead placement.

Certified advertisers must provide proof of licensing, maintain language-appropriate content, and implement age-gating measures, as confirmed by multiple compliance officers.

Maintaining a clean compliance record is particularly crucial. In a notable change, Google warned that manager accounts with past violations and advertisers with previously suspended gaming certificates risk being disqualified or having their certification revoked.

The change leaves remaining advertisers under closer scrutiny, with each advertising decision and compliance incident evaluated in context of their account history.

Not all Operators Will Gain This New Opportunity

Smaller online gaming and betting operators should not assume they will qualify for the new placement. Many lack centralized operations, proper registration, and full compliance with local regulations.

Google has not specified exactly which markets will be included in the Masthead expansion. However, based on existing Google advertising policies and legal frameworks, certified gaming operators will gain access to the Masthead in specific jurisdictions.

Local gambling regulations are expected to limit expansion, particularly in territories with weak oversight or inadequate licensing systems.

Rewards for Compliance

These two policy changes by Google - the stricter certification standards and the expanded access to Masthead for certified operators - create valuable opportunities. Those who maintain compliance, keep licenses current, and demonstrate clean records stand to benefit most from these changes.

"For certified operators, this is a clear growth opportunity," said Johnston. "But for those operating in regulatory gray areas, or without proper local licensing, it's going to be significantly more difficult."

The requirements to maintain verified licensing, operate outside volatile regulatory environments, provide local language content, and enforce age restrictions suggest that not all operators will qualify for Masthead advertising.

However, for certified gaming operators, this expanded reach and access to premium inventory signals Google's commitment to supporting compliant industry growth.
